Disruption & Resolution

We are delighted to invite you to Munich for the 2nd Annual Litigation Conference & 6th Annual T.R.A.D.E. Conference being hosted by the AIJA T.R.A.D.E and Litigation Commissions. In view of all kinds of disruptions our clients are facing, we wish to discuss the effective solutions available taking into account the latest developments in e-commerce, commercial contracting and resolution of international commercial disputes.

During the joint and separate sessions, we will address various topics in that regard. Collective redress, jurisdiction clauses, arbitrability, force majeure, hardship clauses and general terms and conditions are just a few of the issues that are relevant when it comes to prevention and resolution of disruptions. The seminar will examine such issues from all perspectives and offer a platform to exchange experience with respective contract drafting and international disputes.

In our panels we will be joined by lawyers, and in-house counsel, judges and providers of third party funding and asset tracing providing input and insights from practice and experience in different jurisdictions.

All of this will take place in the vibrant city of Munich! Munich is home to several big multinational corporations and a growing Tech hub. Come and enjoy the rich Bavarian culture and the urban night life. A fancy dinner and a traditional “Bier Fest” will make this event unforgettable.

Our kick-off panel will start with insights from Swiss arbitration practitioner Prof Brunner who regularly addresses audiences and publishes on the effects of sanctions on international sales contracts (force majeure, hardship etc.) under Swiss law, the UN Sales Law (CISG) and international contract principles. Speakers, who regularly deal with sanctions in their practice and can share their experience on this topic from another angle, e.g. another jurisdiction, common law country, etc.

On this panel, we will look at effective preliminary measures including asset freezing. This panel will follow a dialog between a litigation funder and an asset tracing provider on the topic "you won the case, but where are the assets?". This panel follows a speech of a judge on the topic "how to make a judge change his/her mind". It will address the importance and value of pleadings in court proceedings in several jurisdictions, providing insights regarding the timing and form of such pleadings. Furthermore, it will deal with the questions on how pleadings are drafted effectively to satisfy the expectations of your client/s and the judge/s.

AIJA shall not be held liable for any expenses the participant may suffer as the result of participant’s failure to comply with his/her obligations.

It is recommended for each participant to purchase a cancellation and travel insurance.

Please note that in-house counsel registrations are subject to review and confirmation by AIJA. AIJA considers in-house counsel professionals who hold a university degree in law allowing access to a bar association and practicing law as an in-house counsel in private, public, or non-profit companies, institutions or organisations. Please note that in-house counsel who are at the same time active as fee-earning lawyers or consultants are not eligible to the discounted in-house counsel fee.
