AIJA Condemns Repression of Protests and Threats to the Rule of Law in Serbia

The Human Rights Committee of the International Association of Young Lawyers (AIJA) expresses deep concern over the recent events in Serbia, particularly regarding the response to peaceful student protests and the lack of transparency surrounding the collapse of the Novi Sad railway station canopy.

The right to peaceful assembly and the demand for accountability are fundamental pillars of the Rule of Law. Reports indicate that student-led protests, organised in response to the tragic collapse that resulted in the loss of 15 lives, have been met with violence and repression. Furthermore, concerns have been raised regarding the failure to conduct a thorough and transparent investigation into the causes of the collapse.

In addition, we note with alarm the threats to the independence of the legal profession in Serbia. The Serbian Bar Association’s recent decision to cease legal work for seven days in solidarity with the protesters highlights the gravity of the situation. The subsequent response from state officials, including remarks undermining the legal profession’s autonomy, represents a direct threat to legal independence. Advocacy is a fundamental component of the Rule of Law, and any attempt to compromise it endangers justice and democracy.

AIJA also takes note of the recent decision by the High Court in Belgrade (05/02/2025), which suspended part of the Serbian Bar Association Assembly’s decision on the complete suspension of work for one month. The suspension of provisions related to the ban on lawyers receiving mail and the establishment of a minimum work process raises serious concerns about judicial interference in the independence of the legal profession. The independence of lawyers is a crucial cornerstone of any legal system, and any measure that undermines this principle poses a significant threat to the Rule of Law.

AIJA firmly condemns any form of repression against peaceful demonstrators and calls upon the Serbian authorities to uphold their obligations under national and international law to respect the rights of individuals, including freedom of expression, peaceful assembly, and the independence of the legal profession. Furthermore, we urge the Serbian government to ensure a transparent and impartial investigation into the Novi Sad railway station tragedy and to hold those responsible accountable.
